Terms of Use

The short version: Our help is free to families — care homes pay us the same fee whichever home you pick, so our advice isn't steered. We're advisors, not a care provider: every home is an independent, state-licensed business, and the final choice is always yours. Prices and open beds change fast, so always confirm details with the home. Use our site like a good neighbor — no scraping or copying our registry. If we ever disagree, we talk first.

These Terms of Use are an agreement between you and Spokane Senior Home Advisors, a trade name of Able Years LLC, a Washington limited liability company ("we," "us"). By using spokaneseniorhomeadvisors.com or our services, you agree to these terms. If you don't agree, please don't use the site or services.

1. What we do

We are an elder and vulnerable adult referral agency operating under chapter 18.330 RCW, Washington's law for senior placement services. We help families find licensed adult family homes and other licensed care settings in Spokane County: we gather your loved one's needs, search our registry of licensed homes, provide a shortlist, arrange tours, attend them with you, and help coordinate a move-in.

If you become a client, Washington law also requires us to give you a written disclosure statement before any referral. You'll receive it, and you'll find it linked in our site footer ("How we're paid"). If anything in these terms conflicts with that disclosure statement, the disclosure statement controls for referrals.

2. What we are not

  • We are not a health care provider. Nothing we say is medical, legal, or financial advice. For medical decisions, talk with your loved one's doctor.
  • We do not own, operate, manage, or control any care home. Every home is an independent business, licensed and inspected by Washington State. We are not the agent of any home, and no home is our agent. Under Washington law, referral agencies are not considered providers and are not responsible for the acts or omissions of a provider (RCW 18.330.150).
  • We are not an emergency service. If someone is in immediate danger or having a medical emergency, call 911.

3. The decision is yours

We give you information, matched options, and a second set of eyes on tours. The choice of home — and any agreement you sign with a home — is between you and that home. We encourage you to confirm care, pricing, and terms directly with any home before deciding.

4. Free to families — how we're paid

Our service is free to families. When a placement happens, the home pays us a fee. The fee works the same way no matter which home you choose, so we have no reason to steer you. Full details are in our written disclosure statement. If your loved one's care will be paid by Medicaid or another public program, Washington law does not allow us to accept a referral fee — we'll still point you to the right free help. You may stop using our service at any time, without any penalty or cancellation fee.

5. About the information on this site

Our registry is built from Washington State licensing records plus facts we gather and verify directly with homes on a regular schedule. But prices, open beds, staffing, and services are controlled by each home and can change without notice — sometimes the same day. Where we show a "verified" fact, it reflects the most recent check, not a guarantee of what's true at the moment you read it. Shortlists are a point-in-time snapshot. Nothing on this site is a guarantee of admission, availability, pricing, or fit. Always confirm with the home.

Our written pledges describe how we work — our process and our effort. They are commitments of service, not guarantees of outcome. The 90-day re-match pledge means we'll do the search again for free; it is not a refund, warranty, or insurance.

6. Who may use the site, and your promises

You must be 18 or older. When you use our services, you promise that:

  • The information you give us is accurate to the best of your knowledge
  • If you share information about another person (such as a parent), you are their family member, relative, domestic partner, or otherwise authorized to help them find care and to share their information
  • You are using the site and services for personal, non-commercial purposes

7. Calls and texts

When you call us, submit our form, or text us, you agree that we may call and text you about your request, including through automated systems and an automated assistant that answers our line. Calls may be recorded; if a call is recorded, we announce it at the start. Message frequency varies. Message and data rates may apply. Reply STOP to end texts or HELP for help — or just tell us, and we'll stop. Consent to texts is not a condition of receiving our help.

8. Acceptable use

Our registry and the work behind it are the heart of this service. You agree not to:

  • Scrape, crawl, harvest, or bulk-download any part of the site or registry, by bot or by hand
  • Copy, republish, or resell our data, shortlists, or content, or use them to build or support a competing service
  • Probe, bypass, or interfere with the site's security or access controls
  • Misrepresent who you are or why you're contacting us

We may limit or block access for anyone who breaks these rules, and we may seek any remedy the law allows.

9. Our content

The site's content — text, design, compilations of data, verification notes, and write-ups — belongs to us or our licensors. Underlying state licensing facts are public records; our selection, verification, and presentation of them are ours. We grant you a limited, personal, non-transferable license to use the site to find care for yourself or your family. Shortlist links we send you are for you and your family and may expire.

10. Third-party sites and services

We may link to other websites (for example, state inspection records or a home's own site). We don't control them and aren't responsible for their content or practices.

11. Disclaimers

The site and services are provided "as is" and "as available." To the fullest extent Washington law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, and we make no warranty about the conduct, care quality, or outcomes of any care home. Nothing in this section takes away rights that Washington law gives you and does not allow to be waived.

12. Limit on our liability

Our services are free to families, and these limits reflect that. To the fullest extent Washington law allows: we are not liable for indirect, incidental, special, or consequential damages, or for the acts or omissions of any care home or other provider; and our total liability to you for any claim related to the site or services will not exceed $100. These limits do not apply to liability that cannot be limited under Washington law, including liability for gross negligence or intentional misconduct, and they do not limit your non-waivable rights under Washington law, including the Consumer Protection Act and chapter 18.330 RCW.

13. If you cause a problem

If your violation of these terms, unlawful use of the site, or knowingly false information causes a claim against us, you agree to cover the resulting losses and reasonable costs.

14. If we disagree

We'd rather fix a problem than fight about it, so here's the order:

  1. Talk to us first. Write to hello@spokaneseniorhomeadvisors.com describing the issue, and give us 30 days to resolve it with you.
  2. Small claims is always open. Either of us may bring an individual claim in small claims court in Spokane County, Washington.
  3. Otherwise, individual arbitration. Any other dispute will be resolved by binding arbitration before a single arbitrator under the American Arbitration Association's Consumer Arbitration Rules, held in Spokane County or by phone/video. If the AAA is unavailable or declines to administer, the parties will select a comparable consumer arbitration administrator. Each of us waives the right to a jury trial and to participate in a class action; claims may be brought only individually. Either party may still go to court for an injunction to stop scraping, data misuse, or infringement under Sections 8–9.
  4. Your right to opt out. You may opt out of this arbitration section, no questions asked, by emailing hello@spokaneseniorhomeadvisors.com with "Arbitration opt-out" and your name within 30 days of first agreeing to these terms. Everything else in these terms still applies.

These terms are governed by Washington law. Any court proceeding that these terms allow will take place in Spokane County, Washington.

15. Complaints

We operate under chapter 18.330 RCW. You may file a complaint about a referral agency with the Consumer Protection Division of the Washington State Attorney General's Office: www.atg.wa.gov/file-complaint, 1-800-551-4636.

16. Changes to these terms

If we update these terms, we'll post the new version here with a new effective date. Continuing to use the site or services after a change means you accept the updated terms.

17. The fine print

If any part of these terms can't be enforced, the rest still applies. Our not enforcing a term once doesn't waive it later. You may not transfer your rights under these terms; we may assign ours as part of our business. These terms, our Privacy Policy, our Consumer Health Data Privacy Policy, and (for clients) the written disclosure statement are the whole agreement about your use of the site and our family services.
